Terms and Conditions for "Above Connect"

These Terms and Conditions ("Terms", "Terms and Conditions") govern your use of the mobile application "Above Connect" ("App") provided by TNCL Holdings Sdn Bhd ("Company", "we", "our", "us"), a company incorporated in Malaysia. By accessing or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the App.

1. User Eligibility

1.1 To use the App, you must be at least 18 years of age or have the permission of a legal guardian if you are under 18. By using the App, you represent and warrant that you meet the eligibility requirements.

1.2 The App is intended for use by residents of Malaysia. If you are accessing the App from outside Malaysia, you are responsible for complying with any applicable local laws and regulations.

2.1 To access certain features of the App, you may be required to register for an account by providing personal information such as your name, email address, and phone number. You agree to provide accurate and complete information during registration.

2.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5.1 All content, features, and functionality on the App, including but not limited to text, graphics, logos, images, and software, are the property of TNCL Holdings Sdn Bhd or its licensors and are protected by intellectual property laws.

5.2 You may not reproduce, distribute, or modify any content from the App without prior written consent from the Company.

6. In-App Purchases

6.1 The App may offer in-app purchases ("In-App Purchases") that require payment. Prices for In-App Purchases are subject to change and are clearly displayed in the App.

6.2 You agree to pay all applicable fees and charges associated with any In-App Purchases made through your account.

7. Disclaimers and Limitation of Liability

7.1 The App is provided on an "as is" and "as available" basis. The Company makes no warranties, express or implied, regarding the accuracy, reliability, or completeness of the App's content or functionality.

7.2 To the fullest extent permitted by law, the Company shall not be liable for any damages, including but not limited to indirect, incidental, or consequential damages, arising from your use or inability to use the App.

8. Termination

8.1 The Company reserves the right to suspend or terminate your access to the App at its sole discretion, without notice, if you violate these Terms.

8.2 You may also terminate your use of the App at any time by uninstalling it from your device.

9. Governing Law

9.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Malaysia.

9.2 Any disputes arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the courts in Malaysia.

10. Changes to Terms and Conditions

10.1 The Company reserves the right to update or modify these Terms at any time. Any changes will be effective immediately upon posting in the App or on the App’s website.

10.2 You are encouraged to review these Terms periodically to stay informed of any updates.
